Our lawyers frequently handle cases related to commercial and residential real estate. We represent developers, buyers and sellers, landlords and tenants, as well as abutters and other potential stakeholders.
In disputes connected to the acquisition of real estate, the parties’ rights are often dictated by their purchase and sale agreement or other contractual documents. We have significant experience litigating disputes over the meaning of contractual terms and the extent to which the parties are in compliance with the contracts.
In recent years, when real estate values have soared in many areas, we have seen many disputes arise between buyers and sellers before closing. When representing buyers in these cases, our lawyers have successfully obtained lis pendens and other injunctions preventing any transfer of the properties in question.
Settlements & Resolutions
We believe that we best serve our clients when we are able to facilitate quick and efficient settlements between the parties. But if litigation is necessary, our ability to obtain injunctions and other preliminary relief early in the case frequently leads to such resolutions.
Affordable Housing Development
We also have deep experience in litigating matters related to affordable housing development under the Massachusetts Comprehensive Permit Act, commonly known as “Chapter 40B.” In fact, two of our lawyers have previously served in the Massachusetts Attorney General’s Office where they represented and advised the Housing Appeals Committee, the state agency charged with administering and enforcing Chapter 40B.
